These Terms govern your use of the Casa Moderna online store and any purchase through it, in line with Maltese and EU consumer law. Please read them before ordering; completing a purchase means you accept them. Nothing here affects your statutory consumer rights, which always apply.
The online store is operated by Casa Moderna Limited, a company registered in Malta ("we", "us", "our"). We sell furniture and related home products.
You must be at least 18 and able to enter into a contract, and are responsible for giving accurate contact and delivery details. Our online store sells and delivers within the Maltese islands (Malta and Gozo) only; for security, orders placed from outside Malta may be declined. If you are outside Malta and wish to buy, please email [email protected] and we will be glad to help.
Photographs and images shown online and on screen are for illustration and may differ from the actual product. Some images may be digitally or AI-enhanced. Colours in particular can look different depending on your screen resolution, brightness and display settings, and natural materials such as fabric, wood, marble and ceramic vary in grain, tone and colour between pieces. Such variations, and approximate dimensions, are normal and are not a defect.
All Goods are subject to availability. Stock shown online is indicative, not a guarantee; if an item becomes unavailable after you order, clause 13 applies.
Prices are in euro (€) and include VAT. Any delivery charge is shown separately before you confirm and added to the total; the price payable is the total shown at checkout.
If we spot a genuine, obvious pricing error after you order, we will contact you to proceed at the correct price or cancel; we are not obliged to supply Goods at an incorrect price.
Submitting an Order and payment is your offer to buy; our on-screen or email acknowledgement confirms receipt but is not acceptance. A binding Contract forms only when we confirm your Order is accepted and payment received. We may decline an Order, for example if Goods are unavailable, mispriced, or payment is not authorised.
Card payments are processed securely by our provider, myPOS, on their hosted page; your card details go to myPOS, and we never receive or store your card number, expiry or security code. Payment is taken when you order. Goods remain ours until paid in full.
We deliver within Malta and Gozo. We agree a delivery window with you and, unless a later date is agreed (e.g. made-to-order pieces), deliver within 30 days of the Contract. Risk passes to you on delivery. Please check the Goods when they arrive. If we miss an agreed date and still fail to deliver within a further reasonable period you set, you may cancel and be refunded for the undelivered Goods.
Unless stated otherwise, Goods are delivered unassembled (flat-packed) and assembly is not included. We offer assembly for an additional charge, quoted in advance. Just ask before or at delivery.
Please ensure the Goods can reach the delivery address by the normal access route. Where a furniture lifter, hoist or crane, or any permit for it or to reserve road/pavement space, is needed for delivery or a return collection, those costs are always borne by you, so far as the law allows. We will flag in advance if we expect a lifter or permit to be needed.
As a Consumer buying at a distance, you may withdraw within 14 days without giving a reason. The 14 days run from the day you (or someone you nominate) receive the Goods, for an Order delivered in parts, from the day the last item arrives.
To withdraw, tell us clearly before the 14 days end, by email to [email protected], by phone, or using the model withdrawal form below (you may use it but need not). Sending your notice before the deadline is enough to meet it.
Returned Goods must be in the same, original packaging and condition in which you received them. Return costs apply as in clause 11 (including any lifter, hoist or permit costs, which are always borne by you so far as the law allows).
The 14-day withdrawal right does not apply to certain Goods, including:
Standard, in-stock items, almost everything in our store, are returnable as normal under clause 9. If an item is made to order or personalised, and so cannot be returned, we tell you before you pay.
After withdrawing (clause 9), return the Goods within 14 days, complete and in their original packaging. Our Goods are sold as new: please keep all packaging and open an item only as far as needed to confirm it is the correct, undamaged product, do not assemble or use it. Any item returned assembled, used, damaged, or without its original packaging can no longer be sold as new, and a deduction reflecting the loss in value, which for furniture is often substantial, will be applied to your refund.
The Goods remain your responsibility and at your risk until they reach us and are accepted. You must pack them securely for return, in their original packaging or equivalent protection, so they are not damaged in transit. Any loss or damage on the way back, including damage caused by inadequate packaging, is your responsibility and will be reflected in your refund.
You pay the direct cost of return (or of us collecting larger items, quoted in advance) and, so far as the law allows, any lifter, hoist, crane or permit charges to remove and return the Goods. A purchased assembly service already carried out is not refundable.
We refund all you paid for the returned Goods, including the standard delivery we charged, within 14 days of receiving them back (or your proof of return, if earlier), by your original payment method and at no extra charge. We inspect returned Goods on arrival and work out any deduction before refunding, and may hold the refund until the Goods reach us.
Separately from withdrawal, you have the statutory legal guarantee of conformity for two (2) years from delivery: Goods must match their description, be of satisfactory quality, free of hidden defects and fit for normal use.
If Goods do not conform, you are entitled to a free remedy: repair or replacement first, and if that is impossible, disproportionate or too slow, a price reduction or a refund. This does not cover damage from misuse, accident, neglect or normal wear and tear. To claim, contact us with your order details and a description (and photos, if possible) of the problem.
If, after you order, Goods turn out to be unavailable, mispriced (clause 5), or your payment is not authorised, we may cancel the affected Order or part of it. Where you have already paid, we will refund you in full for the cancelled Goods without undue delay.
You agree to use the store lawfully, to provide accurate information, and not to attempt to interfere with, misuse or gain unauthorised access to the store or its systems.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury from our negligence, for fraud, or under your statutory consumer rights. Otherwise, we are not liable for losses that are not reasonably foreseeable or are beyond our reasonable control, and our liability for an Order will not exceed the price paid for the Goods, unless the law provides otherwise.
All content on the store, including text, images, logos, designs and layout, is owned by or licensed to Casa Moderna Limited and may not be copied or used without our permission.
We process your personal data in accordance with our Privacy Policy, which forms part of these Terms.
We want you to be happy with your purchase. If something is wrong, please contact us first at [email protected] and we will do our best to resolve it.
If we cannot resolve it, you may refer the dispute to the Office for Consumer Affairs at the MCCAA (mccaa.org.mt) and, if conciliation fails, to the Consumer Claims Tribunal (claims up to €10,000). For cross-border EU purchases you may also contact ECC Malta (eccnetmalta.gov.mt). These are in addition to your right to go to court.
These Terms and any Contract are governed by the laws of Malta. As a Consumer, you may bring proceedings in the courts of Malta, and you also benefit from any mandatory consumer-protection provisions of the country in which you are habitually resident. The Maltese courts and the Consumer Claims Tribunal have jurisdiction over disputes, without prejudice to your statutory rights.
